1. Acceptance & Authority: By accessing or using AtmoShare, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must discontinue use of the service immediately.
2. Nature of Service: AtmoShare is provided solely as a real-time, non-custodial file transfer mechanism. AtmoShare is NOT a persistent cloud storage provider, backup utility, or archival repository. Users remain solely responsible for preserving backup copies of all transmitted data.
3. Intellectual Property & User Content: You retain full title, copyright, and all associated intellectual property rights to the files and materials you transmit through the service. You warrant and represent that you possess all requisite legal rights, permissions, and licenses to transmit the content you share.
4. Prohibited Conduct: You agree not to use AtmoShare to: (a) transmit unlawful, infringing, malicious, or abusive materials; (b) distribute viruses, worms, trojans, ransomware, or damaging code; (c) disrupt, impair, or impose disproportionate burdens on the service infrastructure; (d) circumvent authentication, access controls, or rate limits; or (e) harvest or extract data from other users without authorization.
5. Session Credential Responsibility: You are solely responsible for safeguarding any temporary share links, session codes, and transfer passwords you create. Any party possessing an active link or code may access the designated transfer before session expiration.
6. Intellectual Property of Company: All trademarks, logos, service marks, user interface designs, software code, and documentation comprising AtmoShare are the exclusive property of The Atmosphere LLC and protected by applicable copyright and intellectual property laws.
7. Disclaimer of Warranties: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE ATMOSPHERE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR SYSTEM DOWNTIME ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.
9. Indemnification: You agree to defend, indemnify, and hold harmless The Atmosphere LLC and its affiliates from and against any claims, liabilities, damages, losses, or expenses arising from your violation of these Terms or transmission of unlawful content.
